Terms of Service

These Terms of Service ("Terms") govern your use of the OriginalityScan Service (originalityscan.com, our API, and related services, collectively the "Service"). By creating an account or using the Service you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

1. Your account

You are responsible for activity under your account, including keeping your password secure and not sharing access. Notify us promptly at [email protected] if you suspect unauthorized use.

2. Acceptable use

You agree not to:

• Submit content you do not have the right to submit
• Use the Service to harass, defame, or violate the rights of others
• Attempt to reverse-engineer, scrape, or circumvent rate limits
• Resell or sublicense the Service without a written agreement with us
• Use the Service to produce or evaluate illegal content

3. Pay-per-credit & pack expiry

The Service operates on a pay-per-credit model. By default:

• Every purchased pack — whether 1 credit or 100 — is valid for seven (7) days from the time of purchase. Unused credits expire and are not refunded.
• You can buy additional packs at any time, including while you still have an unused balance. Packs stack and your credits are added together. When you run a scan, the credit is drawn from the pack with the nearest (soonest) expiry date first, so credits are used before they expire.
• We do not auto-renew, auto-charge, or store your card on file. Each purchase is a discrete one-time transaction processed securely; we never store your card details.

Volume contracts for institutions may be governed by a separate Master Services Agreement that supersedes this section.

4. Refunds

If a scan fails on our side (system error, ingestion failure, etc.) we credit the check back to your balance immediately. Beyond that automatic credit-back, purchases are non-refundable. In particular, we cannot refund expired credits, and we cannot refund a purchase for any reason when the Service is functioning correctly.

5. Intellectual property

You retain all rights to documents and content you submit. Submitting a document grants OriginalityScan a limited, time-bound license to process it solely for the purpose of generating your report. This license terminates the moment your report is generated.

OriginalityScan, including all interfaces, software, and reports we produce, is and remains our property and is protected by copyright, trademark, and trade-secret law.

6. Disclaimer of warranties

The Service is provided "as is" without warranty of any kind. While we strive for accuracy, no detection system is perfect and reports should be considered an aid to human judgment, not a substitute for it. We do not warrant that the Service will be uninterrupted or error-free.

7. Limitation of liability

To the maximum extent permitted by law, OriginalityScan's total liability for any claim arising out of these Terms or use of the Service is limited to the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

8. Termination

We may suspend or terminate accounts that violate these Terms or pose risk to other users or our infrastructure. On termination, unused credits expire and account data is deleted in accordance with our Privacy Policy.

9. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

10. Governing law

These Terms are governed by the laws of Malaysia, excluding conflict-of-law rules. Any dispute is subject to the exclusive jurisdiction of the courts in that location.
